Asbestos Bankruptcy Trusts
History of Asbestos Litigation
Beginning in the early 20th century, asbestos was widely used across numerous different industries for its fireproofing and insulating properties. Unfortunately, as the dangers of asbestos exposure became clear, thousands of workers and families began filing lawsuits against the companies responsible.
By the 1980s and 1990s, the volume of lawsuits became overwhelming. Many of the largest asbestos manufacturers, including Johns Manville, Owens Corning, and WR Grace, filed for bankruptcy under Chapter 11. Bankruptcy did not erase liability, instead, a legal solution was created: asbestos bankruptcy trusts.
Under Section 524(g) of the U.S. Bankruptcy Code, companies seeking bankruptcy protection due to asbestos litigation were required to establish asbestos personal injury trusts. These trusts were funded with billions of dollars to compensate both current and future victims of asbestos exposure.
These trusts operate independently and pay claims based on medical diagnosis, work history, and product exposure. Claimants do not have to go to court. Instead, claims are filed directly with the asbestos bankruptcy trusts. At The Bevan Law Firm, we help clients identify which trusts may apply to their unique exposure history and ensure every eligible claim is pursued thoroughly.
